Thank you for choosing CubistAI! These Terms of Service ("Terms") are a legal agreement between you and CubistAI regarding your use of our AI image generation services. By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms.

Account Registration and Security

You may use portions of our Services as a guest, but certain features require you to create an account. When registering for an account, you must provide accurate and complete information and keep it up-to-date. You are responsible for maintaining the security of your account password and are fully responsible for all activities that occur under your account. If you discover any unauthorized use of your account, please notify us immediately.

Service Description

CubistAI provides a cubist-style AI image generation platform that allows users to generate original images through text prompts. We offer two service tiers:

• Free Users: Unlimited generations with a queue, single image per request, queued processing, no persistent storage by default
• Premium Members: No queue / Priority processing, multi-image batches (2/4/8), higher resolution outputs, generation history cloud storage

We reserve the right to modify, suspend, or terminate the Services at any time without notice.

Subscription and Payment

Premium membership is a subscription-based service with monthly or annual payment options. All payments are prepaid and non-refundable unless required by law. You may cancel your subscription at any time, and you will continue to enjoy member benefits until the end of your current billing cycle.

We may adjust subscription prices from time to time, but will provide at least 30 days' notice. Continued use of the service after a price adjustment indicates acceptance of the new price.

User Content and Licensing

Your Prompts: You grant CubistAI the right to use the prompts you provide to generate images. We don't use your prompts for AI model training. By default, your prompts and generated images are only used for generation processing and are not permanently stored, unless you actively choose to save to history or publish to the inspiration gallery.

Generated Images: The intellectual property rights to images generated using our services belong to you, and you may freely use, modify, and distribute them. Only when you actively publish images to the public gallery do you grant us the right to display those images.

Content Restrictions

When using our Services, you may not submit or generate the following types of content:

• Content containing pornography, violence, gore, hate speech, or discrimination
• Content that infringes upon others' intellectual property rights, privacy rights, or other legal interests
• Content that promotes illegal activities or harmful behavior
• Content containing malware, spam, or automated scripts
• Content intended to interfere with or abuse our services
• Content used to engage in any activities that violate applicable laws or regulations

We reserve the right to review and remove content that violates our policies and may restrict or terminate account access for violating users.

Disclaimer

Our Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. CubistAI does not guarantee that the Services will be error-free, secure, or uninterrupted. You understand that AI image generation technology has inherent limitations and uncertainties, and generated images may not completely meet your expectations.

Limitation of Liability

To the maximum extent permitted by law, CubistAI and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses. CubistAI's total liability for any claim will not exceed the amount you paid for our Services in the 12 months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless CubistAI and its affiliates from any claims, losses, or demands arising from your violation of these Terms, your User Content, or your use of the Services.

Modifications to Terms

We may modify these Terms from time to time. Significant changes will be notified at least 30 days in advance. Continued use of our Services indicates your acceptance of the modified Terms. If you do not agree to the new Terms, please discontinue use of our Services.

Termination

We reserve the right to terminate or suspend your access to the Services with or without reason and without notice, including but not limited to your violation of these Terms. Upon termination, your right to use the Services will immediately cease.

Governing Law

These Terms are governed by the laws of China, without regard to its conflict of law principles. Any dispute between you and CubistAI arising from these Terms will be submitted to the courts with jurisdiction where CubistAI's headquarters is located.
